The jurists do not agree on the status of this condition in the Ehsan of the wife. Some believe that this condition is equally valid for the husband and wife, so the wife is also considered Muhsan if she can have sexual intercourse with her husband whenever she wants. On the other hand, some believe that since there is no such obligation for the husband, Ehsan is achieved in the wife in such a way that whenever a man has the will to have intercourse with his wife, she is ready for it. The recent view has been accepted in Article 226 of the Islamic Penal Code adopted in 2013. The results of the present study, which has been done by descriptive-analytical method, show that the theory of equality between husband and wife around the condition of the possibility of enjoying the spouse has a stronger basis, and the narrations related to Ehsan imply such an understanding. In addition, reasons such as the restriction of the wife's right to intercourse once every four months, the hadiths concerning The divorced woman who the man can take back to, and the necessity of protect the family unit, none of which have the ability to undermine the chosen theory. یکی از شرایط تحقق احصان که موجب تشدید حد زنا می‌شود امکان دسترسی شخص به همسرش می‌باشد به‌گونه‌ای که بتواند نیاز جنسی‌اش را برطرف سازد. فقها پیرامون وضعیت شرط مزبور در احصان زوجه اتفاق‌نظر ندارند. برخی معتقدند این شرط نسبت به زوجین به صورت یکسان اعتبار می‌شود، بنابراین زوجه نیز در صورتی واجد احصان تشخیص می‌شود که هر زمان بخواهد امکان نزدیکی جنسی با شوهرش را داشته باشد. در مقابل برخی معتقدند با توجه به این‌که چنین تکلیفی برای زوج وجود ندارد، احصان در زوجه به همین شکل محقق می‌شود که هر زمان مرد اراده‌ی نزدیکی با همسرش را نماید وی آمادگی آن را داشته باشد. موضع اخیر در ماده 226 قانون مجازات اسلامی مصوب 1392 پذیرفته شده است. نتایج تحقیق حاضر که به روش توصیفی تحلیلی سامان یافته نشان می‌دهد که نظریه برابری شرط امکان تمتع از همسر در خصوص زوج و زوجه از پشتوانه محکم‌تری برخوردار است و روایات ناظر بر احصان مقتضی چنین استظهاری هستند. از طرف دیگر دلایلی نظیر تحدید حق زوجه به نزدیکی در هر چهار ماه یک مرتبه، احادیث ناظر بر احصان مطلقه رجعیه و ضرورت صیانت از کیان خانواده هیچ‌کدام توانایی تخدیش در نظریه مختار را ندارند. https://rcjl.qom.ac.ir/article_3422_8ff1d3117bb85eca72ba210dde3707f8.pdf
