An Analysis of the Role of "Concealment" in the Determination of the Punishment for Theft from the Perspectives of Islamic Jurisprudence and Iranian Law

Abstract

One of the conditions established in Islamic jurisprudence and Article 268 of the Islamic Penal Code, enacted in 2013, for the application of the had (punishment) for theft is the "concealment of the act of appropriation." To better examine and elucidate this condition, it is essential to first understand what is meant by concealment and whether this element must be present in all stages of the theft. Furthermore, if an individual is captured on surveillance cameras, does that negate the realization of the prescribed punishment for theft? The responses to these inquiries are not explicitly articulated in the writings of Shia jurists, and consequently, the legislator's approach remains unclear. In the following discussion, drawing on relevant narrations that are central to this discourse, it is demonstrated that despite the existence of eight interpretations regarding the concept of concealment, the most accurate interpretation is that the act of appropriation must occur in a surreptitious and covert manner, even if it is witnessed by ordinary individuals or the owner. This is due to the expression "ya'khudh wa yukhfi," (to grab and conceal) which implies that the term "ya'khudh" (to take) is not absolute and does not encompass overt actions; rather, it must be qualified by the requirement of concealment. Otherwise, no distinction would exist between theft and other offenses, such as embezzlement, as both involve the overt taking of property. In the case of theft, it suffices that the removal of property from its secured location occurs covertly, even if it is captured on surveillance footage.
