Abstract

Different eras of human history from the beginning to the present (from the origin to the destination)are the scene of battle and confrontation between the front of right and wrong.Among the tools used by the tyrants throughout history as a tactic to weaken the right and truth; Rumors and the spread of news and information are false;so that they can achieve their evil goals in this way.Nowadays,rumor makers by using cyber space as a common and borderless environment,try to disturb minds and distort the truth in this.

Who are the rumor makers? Can the republishing of their content by other users be criminalized?Are regulatory bodies related to cyberspace responsible in case of negligence? Under which rule of jurisprudence is the responsibility of users and regulatory bodies proven?The research method in this research is descriptive-analytical along with explanation, analysis and inference.

The summary of the research is that users and regulatory institutions are responsible under certain conditions and the responsibility of users is proven through the principle of helping to sin.And the responsibility of the regulatory bodies in some cases will be based on the possibility of managing and monitoring the behavior of content creators and producers through the rule of helping to sin;And in some other cases, due to the lack of the mastery in relation to foreign communication networks and services in the virtual space, it will be subject to the rule of "nafy-e-Sabil".
