بازخوانی دیدگاه های فقهی ازدواج دوشیزگان در پرتو اصل عدالت

چکیده

اختلاف‌نظرهای فقهی درباره ازدواج دختران بالغ و رشید، به شکل‌گیری چارچوب‌های حقوقی محدودکننده‌ای انجامیده که با ماهیت اجتماعی احکام خانواده و سیاست‌های کلان تسهیل ازدواج ناسازگار است. پژوهش حاضر با روش توصیفی-تحلیلی و با رویکرد فقه اجتماعی و با درک این واقعیت مستحدثه که «دختر باکره رشید» در عصر حاضر، به واسطه تحولات ساختاری، از حیث موضوع‌شناسی فقهی با همتای خود در عصر نزول تفاوت ماهوی یافته، به بازخوانی ادله فقهی در پرتو اصل عدالت پرداخته است. این اصل به عنوان «قاعدة‌القواعد» و «اصل پیش‌فقهی» با چهار ویژگی معیار سنجش احکام، حاکمیت بر ادله، ابتنا بر عرف عقلایی و قابلیت اجرا در حوزه حقوق خانواده، مبنای ارزیابی سه دیدگاه عمده فقهی (ولایت مطلق، تشریک و استقلال) قرار گرفته است. یافته‌ها نشان می‌دهد نظریه استقلال دختران رشید - که دیدگاه مشهور فقهی و پشتوانه‌های محکمی همچون صحیحه فضلاء دارد - افزون بر انسجام استدلالی، با اصل عدالت اسلامی که نافی هرگونه تبعیض و ظلم و مبتنی بر کرامت انسانی و حق طبیعی افراد عاقل و رشید در انتخاب همسر است، کاملاً سازگار بوده و با نیازهای جامعه معاصر و سیاست‌های کلی تسهیل ازدواج جوانان هماهنگی کامل دارد. در مقابل، دیدگاه‌های محدودکننده (ولایت مطلق و تشریک) و قوانین مبتنی بر آنها مانند ماده ۱۰۴۳ قانون مدنی، ضمن ضعف مستندات فقهی و چالش‌های روش‌شناختی در تعامل با روایات معارض، پیامدهای ناعادلانه فردی، اجتماعی و حقوقی در پی داشته و با اصول مسلم نظام حقوقی اسلام تعارض دارند. بنابراین خوانش نوین از ادله فقهی با رویکرد عدالت‌محور و مبتنی بر فقه اجتماعی، گامی مؤثر در اصلاح نظام حقوقی خانواده و تحقق حقوق انسانی دختران رشید در عصر حاضر است.

چکیده [English]

"Divergent jurisprudential opinions and conflicting rulings regarding the marriage of mature and prudent (*Rashida*) girls have led to the formation of restrictive legal frameworks. This is despite the fact that Islamic Sharia considers marriage a natural right for prudent individuals and has devised numerous incentive policies to facilitate it. The 'Principle of Justice', as the *Regula Regularum* (Rule of Rules) of the Islamic legal system, necessitates the observance of the fair rights of this group in their most crucial life choice. Utilizing a descriptive-analytical method, this research examines three major jurisprudential perspectives and evaluates their compliance with the 'Principle of Justice' criterion. The findings indicate that the theory of the 'Autonomy of Prudent Girls' (*Istiqlal*)—as a prominent (*Mashhur*) jurisprudential view—not only possesses argumentative consistency and robust jurisprudential foundations but is also fully compatible with the principle of Islamic justice. This principle negates all forms of discrimination and oppression while emphasizing human dignity and the natural right of rational and prudent individuals in choosing a spouse. Furthermore, this perspective aligns perfectly with the needs of contemporary society and general policies aimed at facilitating youth marriage. In contrast, restrictive views and the laws derived from them, besides suffering from weak jurisprudential evidence, result in unjust social consequences and inconsistency with macro-level state policies. Therefore, a modern re-reading of jurisprudential evidence through a justice-oriented approach is an effective step toward reforming the family legal system and realizing the human rights of prudent girls."
