Artificial insemination, as a modern fertility treatment, has paved the way for individuals facing infertility. However, the legitimacy of this emerging phenomenon has been a major concern for infertile couples. This study aims to examine the jurisprudential challenges of artificial insemination and to establish its acceptance and legitimacy. Most jurists, citing the principle of precaution in sexual matters, Quranic verses and narrations, the necessity of unlawful preliminaries, interference in lineage, and the alteration of divine creation, have deemed artificial insemination absolutely forbidden. However, some jurists, attempting to resolve this significant social dilemma, have challenged these arguments and, relying on the principles of permissibility and exemption, have ruled in favor of artificial insemination. Notably, in cases where artificial insemination is performed using the husband's sperm, most jurists consider it permissible, while disagreements persist in other scenarios, including insemination with donor sperm. This study, using a descriptive and analytical approach, aims to assess the legal implications of childbirth through artificial insemination and to analyze the associated challenges and ambiguities. The findings indicate that none of the well-known jurists' arguments suggest the prohibition of artificial insemination. In all methods of artificial insemination, based on well-established jurisprudential principles, including the principles of exemption permissibility and necessity as well as the therapeutic purpose of artificial insemination and the necessity of treating infertile individuals, religious rulings will apply, even without the husband's consent.
