The remarkable rise of Generative Artificial Intelligence (AI), with its capacity to create novel content, fundamentally challenges existing intellectual property (IP) frameworks. The core issue of this research is the ambiguity in determining IP ownership of works generated by these systems, products of complex human-machine interaction. This article aims to analyze this challenge and propose a framework for attributing IP ownership from the perspective of Imami Fiqh (Islamic Jurisprudence). The necessity is both theoretical and practical; with AI's growing application, clarifying its jurisprudential ruling is crucial for regulating economic, cultural, and legal relations, preventing disorder, rights infringement, and obstacles to proper religiously permissible utilization.The research employs a descriptive-analytical methodology, drawing from Imami Fiqh sources and analyzing key jurisprudential rules: Māliyyah (financial value), Ahliyyat al-Tamalluk (capacity for ownership), Sa'y (effort), Qasd (intention), Mubasharah (direct causation), Sababiyyah (indirect causation), Hiyāzah (acquisition), Taba'iyyat al-Namo' min al-Asl (dependence of increment on origin), La Dharar (no harm), and Hakimiyyat al-Iradah (autonomy of will). These are applied to evaluate various AI-human collaboration scenarios. The main hypothesis posits that due to the machine's lack of Ahliyyat al-Tamalluk, IP ownership of AI-generated works is attributed to the human agent (user or developer), contingent on their involvement, intention, and effort. Findings indicate ownership in the "mere tool" scenario typically vests with the user; in the "creative collaborator" scenario, it generally belongs to the user (with potential for fair contractual adjustment); and in "full autonomy" cases, it pertains to the system's developer. This study emphasizes the importance of transparent, equitable contracts and adherence to the La Dharar rule in navigating these complex IP challenges.
